# What is TDS ?
TDS means Tax Deducted at Source. It is the amount withheld from payments of various kinds such as salary, contract payment, commission etc. This withheld amount can be adjusted against your tax due.

# Is TDS relevant for me as a businessman ?
Yes. Payments may be made to you after TDS. You can adjust this against your final tax liability. You are also required to effect TDS while making business payments. Failure to do so will result in the entire of expenditure being disallowed as your business expenditure and taxed as income.

# I have made some deposits with a bank on which annual interest is around Rs.15000. My income is below taxable limit. The banker wants to deduct tax. What do I do ?
You can file a self-declaration to the banker in form 15H stating that your income is below taxable limit. The form is available with your banker, the local Income-Tax office and can be downloaded from the website http://www.incometaxindia.gov.in/. This form should be filed before the interests begin to accrue in the fixed deposit account, since the declaration has no retrospective effect.

# I have let out a property for Rs.20,000 per month. The tenant is deducting tax that is more than my tax liability. What can I do under this circumstance ?
If you compute your tax liability and find it to be lower than the tax being deducted, you may approach your assessing officer by filing Form 13. He will issue a certificate directing the tenant to make TDS at a lesser rate. This form is available with the local Income tax office or can be downloaded from the website www.incometaxindia.gov.in.

# I have deducted tax from payments disbursed but used the same for some urgent financial needs. What are the consequences ?
It is an offence to misuse the tax deducted at source. It should have been remitted to government account within the time allowed. The failure attracts tax, interest, penalty and also rigorous imprisonment up to seven years.

# What can I do if I am unable to get the TDS certificate [form-16 or 16A] ?
It is the duty of every person deducting tax to issue TDS certificate. In spite of your asking if you are denied the certificate then there is a chance that the tax deducted has not been deposited by the deductor to the government account. Please inform the department [PRO or TDS section] which will then do the needful.

# I have not received TDS certificate from my employer. Can I claim TDS deducted from my salary ?
Yes. The claim can be made in your return. Department however will raise a demand which will not be enforced on you but on your employer.

# If the employer does not deduct tax and employee also does not pay his due tax, who will be held responsible for tax payment ?
The ultimate responsibility to pay tax rests on the person who has earned income. If the employee deposits such tax then the employer will be liable for interest and penalty for failure to deduct tax.

# I am buying a property from a person residing in USA. Should I deduct tax while making payment ?
Yes u/s 195. In case you have any doubt regarding the amount on which TDS is to be made, you may file an application with the officer handling non-resident taxation who will pass an order determining the TDS to be made. Alternatively, if the recipient feels that the TDS is more he may file an application with his Assessing officer for non-deduction.

# Can I use PAN to pay the TDS deducted into government account ?
No. You are required to take a separate Tax Deduction Account Number [TAN] by making an application in form 49B with the Tin facilitation center of NSDL.

# In case the deductee comes back stating that the original TDS certificate is lost, whether a duplicate certificate can be issued ?
Yes. The deductor will have to issue the certificate in a plain paper giving necessary details of deduction and remittance.

Poisonous letter to Obama | Study of Ricin | Castor Seeds



Poisonous Letter to Barrack Obama

On april 17, 2013, it was noticed that some anonymous person sent a suspicious poison-laced letters to Mr. Obama, two days after the Boston bombings. Later, it was discovered that letters were tainted with deadly ricin poison. It is worth mentioning that copy of same ricin-laced letter also sent to senator Roger Wicker.
These letters were intercepted by White house mail faculty. The White House Secret Security Service revealed that the letter was from same sender, who mailed poisonous letter to Republican senator Roger Wicker, one day before the incident. It is believed that there might be link between Boston attacks and these letters.
The contents of a letter read as:
“To see a wrong and not expose it, is to become a silent partner to its continuance.”

and signed as:
“I am KC and I approve this message.”
On may 30, 2013, after a month and a half, the same ricin-laced letters were again intercepted by Mail Screening Faculty (MSF) at White House and the copies of same letters were received by Repulican Senator of New York City, Michael Bloomberg. Mr. Bloomberg is Mayor as well as a Billionaire who supports National Movement against illegal Guns Control. As per the latest reports, an Actress named Shannon Richardson from Texas was arrested on June 9, 2013 for allegedly sending ricin-tainted letters to Prez Obama and NYC Mayor Bloomberg. Now, question arises is what is Ricin, and from where it is obtained. Have a read:

Study of Castor Oil plant

Castor oil is obtained from pressing castor beans (the seeds of a plant which has the botanical nameRicinus communis of the family Eurphorbiacae. The oil is a pale yellow, viscous, non-volatile and non-drying with a bland taste, obtained either by one or a combination of mechanical pressing or solvent extraction. It finds uses as a purgative, a plastic and textile finishing material, in paints and varnishes, a feedstock to the transesterification process for the production of biodiesel, as well as in the beauty industry as a cosmetic and hair oil. Castor oil has an advantage over other mineral oils in that it is a biodegradable, eco-friendly and renewable resource. It is found mainly in the southeastern Mediterranean Basin, Eastern Africa, and India etc.
Castor oil (ricinus oil, phorboyl, tangantangan oil) is a natural oil derived from the seeds of the castor bean by cold pressing (for medicinal use) or hot pressing (for industrial purposes). Chemically, castor oil is a triglyceride characterized by a high content of ricinolein (a glyceride of 12-hydroxy-9-octadecenoic acid). It has the approximate fatty acid composition of ricinoleic acid (87%), oleic acid (7%), linoleic acid (3%), palmitic acid (2%), stearic acid (1%), with trace amounts of dihydroxystearic acid (Windholz, 1976).
Castor seed is the source of castor oil, with wide variety of uses. It is flowering plant. The castor seeds is a castor bean, not actually a bean, contains 40% to 60% oil that is rich in triglycerides, mainly ricinolein. The seed contains ricin, a toxin, which is also present in lower concentrations throughout the plant. So, we can say somehow whole of a plant is carrying poisonous content.

What is Ricin

Ricin sometimes known as raisin is protein found in Castor oil plant. It is a highly toxic, naturally occurring carbohydrate-binding protein of the type known as lectins. It is comprised largely of triglycerides with a high ricinolin content. In an experiment for the Toxicity studies, exposure to castor oil at dietary concentrations as high as 10% in 13-week studies did not affect survival or body weight gains of rats or mice (10 per sex and dose). Liver weights were increased in male rats receiving the 10% dietary concentration and in male and female mice receiving diets containing 5% or 10% castor oil.
Accordong to US Centers for Disease Control (CDC), Ricin, if inhaled, eaten, or injected, is so powerful poison that even a lethal dose in humans of about the size of a grain of salt (500 micrograms injected or inhaled) can lead to a death. It is a water soluble but cannot be absorbed through the skin, so simply touching ricin or getting ricin powder in your eyes will not cause poisoning.

Consumer Complaint | First Appeal | Revision Petition | Transfer Application Guide | India


Consumer Complaint (CC)
Consumer Complaint as provided under Section 21(a)(i) of theConsumer Protection Act, 1986, where the value of the goods or services and compensation, if any, claimed, exceeds Rupees One Crore is to be filed in with the Registry of this Commission within a period of  two years from the date on which the cause of action has arisen. Complaint can be filled on all working days (Monday to Friday) between 10:00 A.M. to 4:30 P.M. at Ground Floor ‘Upbhokta Nyay Bhawan’ , ‘F’ Block, General Pool Office Complex, INA, New Delhi-110 023. Consumer Complaint should be signed by the complainant and supported by a Notarised attested affidavit with 1+3 sets + Number of Opposite Parties.  (with file cover). The Consumer Complaint along with all the copies should be paginated and duly indexed in the following seriatim:-
1. Index
2. List of Dates
3. Memo of Parties (with fresh complete addresses)
4. Complaint with Notarised attested affidavit
5. Supporting documents in favour of complaint e.g. receipt, voucher etc. (All the Annexures must be attested as True Copy on the last page with name & signature)
6. Application for condonation of delay with Notarised attested affidavit, if beyond limitation. (2 years from cause of action)
7. Fee for Rs.5,000/- for making Consumer Complaint (Demand Draft in favour of “The Registrar, NCDRC, New Delhi”)

First Appeal (FA)
First Appeal as provided under Section 19 of the Consumer Protection Act, 1986-Any person aggrieved by an order made by the State Commission in exercise of its powers conferred by sub-clause (i) of clause (a) of section 17 may prefer an appeal against such order before this Commission within a period  of  thirty days from the date of receipt of the order on all working days (Monday to Friday) between 10:00 A.M. to 4:30 P.M. at Ground Floor, ‘Upbhokta Nyay Bhawan’, ‘F’ Block,  General Pool Office Complex, INA, New Delhi – 110 023.  First Appeal must be supported by a Notarised attested affidavit with 1+3 sets + Number of Opposite Parties(with File cover).  The First Appeal along with all the copies should be paginated and duly indexed in the following seriatim:-
1. Index
2. List of Dates
3. Memo of Parties (with fresh complete addresses)
4. Appeal with Notarised attested affidavit
5. Stay Application, or any other application if any, with Notarised attested affidavit
6. Application for condonation of delay with Notarised attested affidavit, if beyond limitation. (Within 30 days of receipt of order)

Revision Petition (RP)
Revision Petition as provided under Section 21(b) of the Consumer Protection Act, 1986-to call for the records and pass appropriate orders in any consumer dispute which is pending before or has been decided by any State Commission can be filed with the Registry of this Commission within a period  of  ninety days from the date of receipt of the order on all working days (Monday to Friday) between 10:00 A.M. to 4:30 P.M. at Ground Floor, ‘Upbhokta Nyay Bhawan’, ‘F’ Block,  General Pool Office Complex, INA, New Delhi – 110 023.
Revision Petition must be supported by a Notarised attested affidavit with 1+3 sets + Number of Opposite Parties (with File cover).  The Revision Petition along with all the copies should be paginated and duly indexed in the following seriatim:-
1. Index
2. List of Dates
3. Memo of Parties (with fresh complete addresses)
4. Revision Petition with Notarised attested affidavit
5. Stay Application, or any other application if any, with Notarised attested affidavit
6. Application for condonation of delay with Notarised attested affidavit, if beyond limitation. (Within 90 days of the receipt of the order)
7. Certified copy of order of State Commission
8. Copy of order of District Forum
9. Copy of Complaint, Reply & Rejoinder filed before District Forum as well as copy of evidence if recorded and other documents relied on by both parties. (All the Annexures must be attested as True Copy on the last page with name & signature)


Transfer Application (TA)
Transfer Application as provided under Section 22 B of the Consumer Protection Act, 1986-On the application of the complainant or of its own motion, the National Commission  may, at any stage of  the proceeding, in the interest of  justice, transfer any complaint pending before the District Forum of one  State to a District Forum of another State or before one State Commission to another State Commission, can be filed with the Registry of this Commission on all working days (Monday to Friday) between 10:00 A.M. to 4:30 P.M. at Ground  Floor, ‘Upbhokta Nyay Bhawan’, ‘F’ Block, General Pool Office Complex, INA, New Delhi-110 023. Transfer Application must be supported by a Notarised attested affidavit with 1+3 sets + Number of Opposite Parties (with file cover).  The Transfer Application along with all the copies should be paginated and duly indexed in the following seriatim:-
1. Index
2. Memo of Parties (with fresh complete addresses)
3. Transfer Application with Notarised attested affidavit
4. Copy of complaint and appeal filed before forum below (All the Annexures must be attested as True Copy on the last page with name & signature)

Note :
1. The documents shall be filed in English language only or translated copy of any other language, duly typed in double space on one side of the paper. If any supporting documents are not legible the same will not be accepted until clear legible/photo copies are filed.
2. If the documents are not filed as per in the format mentioned above the same will be returned to the parties at the counter itself without acknowledgement and will only be registered after removing the defects.
3. After the issue of notice, any documents in a case, the same has to be served on the other side and 1+3 sets be filed with proof of service. No document will be accepted unless filed two days (working days) in advance from the date of hearing.
4. Henceforth, the review petition/application for recalling of order will be listed before the bench by way of circulation in chambers.
5. The counsel or the parties appearing in person are filing a common petition / appeal against common order passed by the State Commission in a bunch of appeals / complaints. It causes inconvenience to the Hon’ble Benches to decide the independent issues pertaining to each matter, such as award of different amounts to different parties, etc. Hence, the Hon’ble President is pleased to direct the parties / Counsel to file independent or separate appeals/revision petitions, against each appeal/complaint decided by the State Commission in the common order.
6. No. of copies to be filed in the Commission 1+3 sets + Number of Opposite Parties (with File cover).
7. Caveat Application filed in the Commission in Revision Petition and First Appeal has to be filed in 1+3 sets along with proof of service on Opposite Parties and also copy of order of the State Commission.
8. Application for Certified copy of order must be made on Letter Head with signature & Rubber stamp by counsel with a statement that first free certified copy has not been received either by the party-in-person or their counsel.
9. Duplicate certified copy shall be issued on payment basis as per Regulation with a clear endorsement that earlier first free certified copy was sent by post at the address of the party-in-person or to their Counsel / Authorized Representative.

    The Central Council is headed by Minster, In-charge of the Department of Consumer Affairs in the Central Government and the State Councils by the Minister In-charge of the Consumer Affairs in the State Governments. It also provides for a 3-tier structure of the National and State Commissions and District Forums for speedy resolution of consumer disputes.
    To provide inexpensive, speedy and summary redressal of consumer disputes, quasi-judicial bodies have been set up in each District and State and at the National level, called the District Forums, the State Consumer Disputes Redressal Commissions and the National Consumer Disputes Redressal Commission respectively. At present, there are 629 District Forums and 35 State Commissions with the National Consumer Disputes Redressal Commission (NCDRC).
    The provisions of this Act cover ‘goods’ as well as ‘services’. The goods are those which are manufactured or produced and sold to consumers through wholesalers and retailers. The services are in the nature of transport, telephone, electricity, housing, banking, insurance, medical treatment, etc.
    A written complaint, can be filed before the District Consumer Forum for pecuniary value of upto Rupees twenty lakh, State Commission for value upto Rupees one crore and the National Commission for value above Rupees one crore, in respect of defects in goods and or deficiency in service. The service can be of any description and the illustrations given above are only indicative. However, no complaint can be filed for alleged deficiency in any service that is rendered free of charge or under a contract of personal service.
    The remedy under the Consumer Protection Act is an alternative in addition to that already available to the aggrieved persons/consumers by way of civil suit. In the complaint/appeal/petition submitted under the Act, a consumer is not required to pay any court fees but only a nominal fee.
    If a consumer is not satisfied by the decision of a District Forum, he can appeal to the State Commission. Against the order of the State Commission a consumer can come to the National Commission.

Tomatoes, apples, pears and bananas all produce ethylene gas. Due to the polyphenyl oxidase enzyme in bananas polymerizing phenols in the banana peel turns into polyphenols.
    If you put an apple or tomato in a bag with bananas, that will speed the ripening. Because bananas produce it, you can place the bananas in a bag to trap the gas and ripen them faster.
    It is better to store bananas outside the refrigerator to prevent instant ripening.
